EchoBBS Terms of Service

1. Agreement

EchoBBS.com is operated by ThunkTunk LLC, a Virginia limited liability company. In these terms, "EchoBBS", "we", and "us" mean ThunkTunk LLC.

By creating an account, launching a board, joining a board, or otherwise using EchoBBS, you agree to these terms and to our Privacy Policy. If you do not agree, do not use EchoBBS.

2. Who can use EchoBBS

You must be at least 18 years old. By using EchoBBS you confirm that you are.

3. What EchoBBS is

EchoBBS is a hosting platform for bulletin board systems. A sysop creates and runs a board. A caller is a member of a board.

Each board is run by its sysop, who is an independent user and not our employee or agent. Sysops set their own rules and decide who can join. We do not pre-screen what sysops or callers post, and we are not responsible for it.

4. Your account

  • Give accurate information when you sign up.
  • Keep your password private. You are responsible for what happens under your account.
  • Tell us promptly at abuse@echobbs.com if you believe someone else has used your account.

5. If you are a sysop

You are responsible for your board. Beyond these terms, what is allowed on your board is your decision, including whether to allow adult content. Your responsibilities include:

  • Content and conduct. Setting rules for your board and moderating it so that it stays within these terms.
  • Caller information. You can see certain information about your callers, such as signup answers and, for some callers, an email address. Use it only to run your board. Do not sell it, publish it, or use it to send marketing without the caller's consent.
  • Signup questions. Do not ask callers for sensitive information such as government ID numbers, financial details, or health information.
  • Co-sysops. You are responsible for the actions of anyone you appoint to help run your board.
  • Your board's name and address. Do not choose a name or address that impersonates another person or organization or infringes a trademark. We may reclaim or rename a board address that does.
  • The law. Complying with the laws that apply to you and your board.

6. If you are a caller

Follow these terms and the rules of each board you join. A sysop may restrict, ban, or remove you from their board at any time and for any reason. If a sysop removes you, your posts, messages, and game progress on that board are deleted.

7. What is not allowed

You may not use EchoBBS to:

  • Post or share anything illegal.
  • Post or share sexual content involving minors. We have zero tolerance for this. We will remove it, close the accounts involved, and report it to the authorities.
  • Harass, threaten, or stalk anyone, or encourage others to.
  • Publish someone's private information without their consent.
  • Impersonate another person or organization.
  • Infringe anyone's copyright, trademark, or other rights.
  • Send spam or unwanted advertising.
  • Distribute malware, or try to break, overload, or gain unauthorized access to EchoBBS or to any board or account.
  • Get around rate limits, bans, or access controls.
  • Scrape or harvest information about other users.

8. Your content

You keep ownership of what you post.

By posting content on EchoBBS, you give us a non-exclusive, worldwide, royalty-free license to host, store, copy, and display that content as needed to operate the service. The license ends when the content is deleted, except for copies held in backups for a limited time.

You are responsible for what you post, and you confirm that you have the right to post it.

9. Door games, credits, and scores

Door games are for entertainment. Credits, scores, items, and anything else you earn in them have no monetary value and cannot be exchanged for money or anything of value. No real money is wagered or paid out in any game, including the casino and lottery games.

Game data may be reset or removed at any time by a sysop or by us.

10. Moderation and enforcement

We do not monitor or pre-screen boards, and we do not police how sysops run them. We act when a problem is reported to us or when the law requires it. In those cases we may remove content, suspend or close a board, or suspend or close an account if we believe these terms have been broken or that there is a risk of harm to users, to EchoBBS, or to others.

To report a board, a caller, or a piece of content, email abuse@echobbs.com.

If you believe content on EchoBBS infringes your copyright, email legal@echobbs.com. Tell us who you are, what work is yours, and the address on EchoBBS of the material you are complaining about. We will review the complaint and may remove the material.

We close the accounts of people who repeatedly infringe.

12. Price and changes to the service

EchoBBS is currently free to use. If we introduce paid features, we will tell you before you are charged for anything.

We may change, suspend, or discontinue any part of EchoBBS. Where we reasonably can, we will give notice before a change that significantly affects you.

13. Ending your use

You can stop using EchoBBS at any time. A sysop can delete their boards from the sysop console. To delete your account, email privacy@echobbs.com.

We may suspend or end your access at any time if you break these terms, or if we stop offering the service.

14. Other people's sites and names

Boards may link to other websites. We do not control them and are not responsible for them. Names of classic games and software mentioned on EchoBBS belong to their respective owners.

15. No warranty

EchoBBS is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will be uninterrupted, secure, or free of errors, or that content will never be lost.

16. Limit of liability

To the fullest extent the law allows, ThunkTunk LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of EchoBBS.

Our total liability for any claim relating to EchoBBS is limited to the greater of 100 US dollars or the amount you paid us in the 12 months before the claim.

17. Indemnity

You agree to defend and indemnify ThunkTunk LLC against any claim, loss, or expense, including reasonable legal fees, arising from your content, your board, your use of EchoBBS, or your breach of these terms.

18. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction.

19. Changes to these terms

We may update these terms. We will post the new version here and update the effective date. If a change is significant, we will also tell sysops by email. Continuing to use EchoBBS after a change takes effect means you accept the new terms.

20. General

These terms and the Privacy Policy are the whole agreement between you and us about EchoBBS. If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term, that is not a waiver of it. You may not transfer your rights under these terms. We may transfer ours as part of a sale or reorganization of the business.
